Terms of Service

Plain-language summary: These Terms govern your use of K&R Innovations’ websites, digital content, communications, and official social-media pages. K&R Innovations uses Postiz only as an internal tool to manage its own social-media accounts; it does not use Postiz to manage visitors’ or customers’ social accounts.

1. Agreement to these Terms

These Terms of Service (“Terms”) govern access to and use of websites, webpages, forms, digital materials, communications, and official social-media accounts operated by K&R Innovations (“K&R Innovations,” “we,” “us,” or “our”), collectively, the “Services.” By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Scope of the Services

K&R Innovations may provide information about its projects, technology, consulting, creative work, educational initiatives, products, events, partnerships, and related activities. The availability and features of the Services may change without notice.

Our presence on third-party platforms—including social-media, video, messaging, payment, hosting, analytics, and form providers—is also governed by each platform’s terms and policies. K&R Innovations does not control and is not responsible for third-party services.

3. Social-media management and Postiz

K&R Innovations uses Postiz as an internal scheduling, publishing, and analytics tool for K&R Innovations’ own authorized social-media accounts. We do not offer visitors a service for connecting, scheduling, publishing to, or administering their social-media accounts, and we do not request visitors’ social-platform passwords or OAuth credentials.

Posts, comments, messages, reactions, and other interactions made through a social platform remain subject to that platform’s terms, privacy policy, community standards, and technical rules. A platform may restrict, remove, delay, or misdeliver content independently of K&R Innovations.

4. Eligibility and appropriate use

You must be legally capable of agreeing to these Terms. You agree not to:

• use the Services for unlawful, fraudulent, deceptive, harassing, abusive, or harmful conduct;
• attempt to gain unauthorized access to any account, system, data, or nonpublic area;
• introduce malware, interfere with operation of the Services, evade security controls, or conduct unauthorized automated scraping;
• impersonate another person or misrepresent an affiliation with K&R Innovations;
• infringe intellectual-property, privacy, publicity, or other legal rights; or
• use K&R Innovations’ name, branding, content, or accounts to imply an endorsement without written authorization.

5. User communications and submissions

If you send us content, feedback, questions, testimonials, media, or other materials, you represent that you have the right to do so and that your submission does not violate law or third-party rights. You retain ownership of your submission. You grant K&R Innovations a nonexclusive, worldwide, royalty-free license to receive, store, reproduce, and use it as reasonably necessary to respond, provide requested services, maintain records, protect the Services, and fulfill the purpose for which it was submitted.

We will not publicly identify you with a testimonial or promotional submission without permission unless your submission was already made publicly, such as a public social-media comment.

6. Intellectual property

Unless otherwise stated, the Services and their original text, designs, graphics, logos, audio, video, software, and other content are owned by or licensed to K&R Innovations and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for lawful personal or internal business purposes. No other rights are granted.

7. Purchases, projects, and separate agreements

Any purchase, paid engagement, subscription, proposal, statement of work, license, or project may be governed by additional terms. If those additional terms conflict with these Terms, the additional terms control for that transaction or project. Prices, availability, payment terms, delivery dates, refund rights, and warranties are determined by the applicable offer or written agreement and mandatory law.

8. Informational content; no professional advice

General content is provided for informational and educational purposes. It is not legal, medical, financial, tax, or other regulated professional advice. You are responsible for evaluating information and obtaining appropriate professional advice before acting on it.

9. Third-party links and services

The Services may link to or embed third-party sites, applications, content, or tools. Links do not necessarily imply endorsement. K&R Innovations is not responsible for a third party’s availability, accuracy, security, practices, content, or transactions. Your dealings with a third party are between you and that third party.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” K&R Innovations disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security. We do not guarantee uninterrupted operation, error-free content, specific results, or continued availability on any third-party platform.

11. Limitation of liability

To the maximum extent permitted by law, K&R Innovations and its owners, personnel, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or opportunities arising from or related to the Services. To the maximum extent permitted by law, total liability for all claims relating to free Services will not exceed US $100; for a paid service, it will not exceed the amount you paid K&R Innovations for that service during the six months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted by law and do not limit nonwaivable consumer rights.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless K&R Innovations and its owners, personnel, contractors, and affiliates from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, or your infringement of another person’s rights.

13. Suspension and termination

We may restrict or terminate access to the Services when reasonably necessary to protect users, K&R Innovations, third parties, systems, or legal compliance. Provisions that by their nature should survive termination—including intellectual-property, disclaimer, liability, indemnification, and governing-law provisions—will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction in Alabama, unless applicable law requires otherwise. Nothing in these Terms waives a right or remedy that cannot legally be waived.

15. Changes to these Terms

We may update these Terms as the Services, technology, or legal requirements change. The revised version will be posted with an updated effective date. Material changes will be communicated when required by law. Continued use after an update takes effect constitutes acceptance of the revised Terms.

16. General provisions

These Terms and any applicable additional agreement constitute the entire agreement concerning their subject matter. If a provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, merger, acquisition, or transfer of relevant assets.
